Is my flight legal in Brazil?

A paid charter in Brazil must be flown by an air taxi company certified by the National Civil Aviation Agency (ANAC) under RBAC 135. Paid flights in a private aircraft without that certificate are clandestine air transport, known as TACA.

Overview

Who may fly you

Who can legally fly a paid charter in Brazil?

An air taxi company certified by ANAC. ANAC says an aircraft can only operate as an air taxi after a certification process with the agency, under RBAC 135. Paid passenger transport by a person or company without the required certificates or authorisation is clandestine air transport (TACA).

The question to ask is simple: which company is the operator, and is it an ANAC-certified air taxi company with this aircraft? The operator may be a different company from the one selling you the flight.

Every flight we arrange is flown by a certified operator named on your quote. Our broker disclosure explains our role, and our safety page explains how we check operators.

The national regulator

ANAC air taxi certification

ANAC certifies air taxi companies under RBAC 135, the regulation for complementary and on-demand operations. ANAC's own comparison with RBAC 91, the rules for private aviation, sets out where they differ: pilot training and flight experience, insurance, and maintenance management.

ANAC's documents distinguish aircraft in the air taxi category (TPX) from private aircraft (TPP). A private aircraft flying under RBAC 91 is not an air taxi, whatever the owner charges.

Each company on our Brazil list appears in ANAC's open data on national air operators, with the ANAC ordinance (portaria) that authorises it under RBAC 135.

What TACA is, and what it costs the seller

ANAC defines clandestine air transport (TACA) as transport carried out for payment by a person or company without the certificates or authorisation required. ANAC adds that transport is not free just because no fare is charged, if the carrier gains an indirect advantage.

ANAC raised the fines for TACA by amending Resolution 472 of 2018. The aeronauts' union reports the range as R$ 12,000 to R$ 200,000, up to ten times the earlier amounts.

Who does what

What a broker does, and does not do

A broker arranges a flight on your behalf with an operator that holds the certificate. The broker does not fly the aircraft and is not the operator. The ANAC documents we read set rules for the operator, not for the broker.

We act as broker. The operator's name and ANAC authorisation appear on your quote, and the operator is responsible for the flight, the crew and the aircraft.

How to check an operator

  1. 01
    Ask who the operator is

Get the full company name of the operator, which can differ from the brand or the seller.

  2. 02
    Check it in Voe Seguro

ANAC's Voe Seguro tool, launched in March 2019, lets you check in advance the details of authorised companies and fit aircraft.

  3. 03
    Check the aircraft

Ask for the aircraft registration and check it in Voe Seguro too. The aircraft must be one the air taxi company is authorised to use.

  4. 04
    Check a foreign operator

A foreign air carrier planning non-scheduled flights to Brazil needs prior authorisation from ANAC, with its own regulator's AOC and operations specifications and an insurance certificate.

  5. 05
    Read the price

A charter is priced for the whole aircraft. A price far below other quotes is a reason to ask why.
